    Background

    Purpose

    This role will drive legal research and analysis to support Ilifa's vision of ensuring universal access to quality ECD. They will be responsible for informing key pieces of legislation, regulation, and policy affecting the Early Childhood Development sector, and will develop robust legal arguments for the right to ECD as well as practical legal instrument that enables the expansion of quality ECD. Core to this role is the ability to popularise legal reform work with the aim of galvanising support for it.

    The successful candidate will be an innovative thinker, inspired to use the legal and policy frameworks to drive improved quality of and access to ECD services in South Africa.

    Responsibilities

    • Develop enabling legal frameworks for ECD: Locate, evaluate and analyse legal sources to inform new legislation and refine government reforms proposed by Ilifa. Keep abreast of relevant parliamentary processes and decisions. Develop research based legal arguments for the ways in which government can, and should, rapidly expand quality access to ECD. Comment on or inform amendments to relevant Acts, regulations, bylaws, and policies.
    • Technical Legal Drafting of ECD law and regulation : Provide technical support for the drafting of a standalone ECD Act, refinement of norms and standards for early learning programmes, and the design of intersectoral partnership arrangements for the scale-up of quality ECD.
    • Advocacy and stakeholder engagement: Support Ilifa colleagues and partners to inform relevant advocacy strategies underpinned by the human rights framework. Develop information materials such as discussion papers, articles and policy guidelines based on evidence and their practical application, and present these on public platforms to popularise legal reform work. Convert complex legal papers into easy-to-understand short papers. Participate in and contribute to legal think tanks and other bodies of influence to increase awareness of ECD rights.

    Requirements

    • Post-graduate qualification in Law
    • At least 5 years' legal research experience, ideally in social justice or the development sector
    • Excellent knowledge and understanding of the Constitution, government systems, legislation, regulatory and policy frameworks.
    • Understanding of the powers and functions of different spheres of government
    • Working experience in children's rights and/or education law is preferred.
