Debt Review Legal Agent
Legal proceedings play a crucial role in ensuring the protection of the consumer during the debt review process with their credit providers.
We are looking for a driven and detail-orientated individual to join our team that meets the requirements to fulfil this role.
-Key Responsibilities:_
- Quality Assurance: Screening each debt review matter to ensure it meets the requirements of the Magistrates Court and/or the National Consumer Tribunal.
- Founding Affidavits: Analysing, printing and distribution of the original founding affidavits to and from the debt counsellor, commissioner and attorney firm.
- Confirmatory Affidavits: Contacting and arranging collection of the original confirmatory affidavit to and from the consumer and attorney firm.
- Updated supporting documentation: Contacting and arranging collection of updated supporting documentation from the consumer and to the attorney firm.
- Set Downs and
Granted Orders:
Analysing the Notice of Motions and Granted Orders to ensure legitimacy, workbook updates as per service level agreement, payment plan alignments, customer communication and DHS update instructions.
- Adjournments: Updating and communicating postponement reasons at court and rectifying before the next hearing date.
- Oppositions: Negotiating with credit providers and consumer for settlement to ensure a fair and equitable agreement between debt counsellor, consumer and credit provider.
- Draft Orders: Updating of the draft court orders in line with credit provider, debt counsellor and consumer agreements before the court hearing.
- Courier & driver collections: Completing and submitting of job cards for courier and/or driver collection for consumers.
- Court Outcomes: Updating consumers, colleagues and credit providers with court outcomes upon request.
- Instructions: Providing written instructions to attorney firms.
- Debt Review Removals: Communicating and actioning of instructions with consumers and attorney firm to ensure consumer is declared not overindebted by the court.
Requirements:_
- Matric
- Sound understanding of the debt review process and National Credit Act.
- A sound ability to negotiate.
- Speaks English and Zulu.
- Previous experience in banking, legal and/or formal legal qualification would be advantageous.
- Proficiency in excel, word and sharepoint.
