    Job Description

    To provide general advisory guidance to the organisation on various transactional legal matters relating to business and consumer lending products, with the intention of enabling the maximisation of revenue streams in accordance with the legal entity mandate and regulatory requirements. This includes drafting/vetting and the negotiation of moderately complex loan/facility documentation, security and ancillary documentation, security sharing agreements and any other related finance agreements specific to the consumer; business and commercial customer portfolios; advisory and opinion work; research on various legal issues pertaining to credit and commercial matters. To create, review, update (enhance) and provide input into standard legal documentation (product terms and conditions, security agreements and ancillary documentation) in collaboration with other Legal team members (as applicable), business units and risk partners. Mitigate risk through conducting the appropriate due diligence, regulatory reviews, template management and provide support in respect of legal documentation in line with approved processes and policies. Input to industry position papers, legislation.

    Other Minimum Qualifications, certifications or professional memberships : Post Graduate Degree - LLB; Admitted attorney; Relevant professional membership

    Experience Required

    5-7 years proven experience in the provision of legal advice, drafting, vetting, review, dissemination and negotiation of general commercial agreements, with at least 5 years' experience within the legal and/or financial and/or corporate/commercial sectors. Identification and mitigation of legal risk.

    Experience in South African Schools Act, Higher Education Act, Consumer Protection Act, National Credit Act, Municipal Finance Management Act, Public Finance Management Act, the Companies Act, Protection of Personal Information Act; Code of Banking Practice and other related legislation; Agriculture and Commercial Banking.
