Purpose of the Job


To lead and manage, provide specialised forensic litigation and legal support to a team of investigators and assistant investigators that are responsible for investigating contraventions of financial sector laws and executing all concomitant enforcement decisions.

The appointed person will report to the Departmental Head:
Enforcement Department.


Key Performance Areas:


  • To provide ongoing advice, guidance, and quality review of documents to enable subordinates to effectively perform their functions. To mentor, empower, upskill, and develop subordinates to reach full potential.
  • Manage and proper oversight over investigations conducted by team.
  • Manage and proper oversight over enforcement process.
  • Drafting and/or reviewing enforcement related documents, including investigation and enforcement reports, notices, audi letters, orders, directives, public warnings etc.
  • Quality review
- review and quality control all reports, recommendations, and decisions with specific reference to correct outcomes.

  • Productivity of teamensure that work delivered by the team is of highquality standard and on time.
  • Team leadership
- ensure that all staff in own area are skilled and empowered to perform their functions.

  • Identify and implement methods to improve efficiency and quality.
  • Conduct biannual performance appraisals.
  • Provide high quality legal advice and opinions, which include a broad legal and regulatory practical approach.
  • Provide advice on evidence in investigations and enforcement matters.
  • Prepare and make submissions during Enforcement Committee and EXCO meetings where enforcement related decisions are made.

An LLB or BCom degree or similar qualification.

With 10 to 15 years' experience in civil litigation, drafting of pleadings, forensic investigations, criminal prosecution, evidence gathering and presentation of cases, including managing a team of forensic investigators.

Technical knowledge of investigation techniques, rules of evidence, financial sector laws the FSCA is responsible for and the functioning of the system of financial regulation in SA.

A specialised and in-depth knowledge of legislation administered by the FSCA.
