Description
Provide professional guidance to SACAP and monitor compliance in relation to its legal, regulatory and statutory aspects of its mandate
Drafting of legal contracts such as Service Level Agreement (SLAs), Employment contracts, Consultancy Agreements; Project Management Contracts.
Develop and maintain a Code of Conduct
Develop and maintain the Inquiry system (process, policy and procedures)
Develop and maintain an investigation system (i.e. process, policies and procedures
Develop and maintain an Investigation Practice (i.e., standards and rules)
Co-ordinate the activities of the Tribunals
Prepare and issue disciplinary charges
Manage the disciplinary inquiries and imposition of sanctions as each case requires
Prepare and issue notices for penalties and fines
Submit fine notices to Finance Officer for collection
Undertake legal research and benchmark studies
Develop public advisory notes (and alerts) on issues related to Architectural Professional.
Develop case studies, based on disciplinary hearings concluded, highlighting lessons learned
Lead special projects and programmes
Manage Project resources (i.e. people, time and funds)
Manage activities, performance and development of staff
Manage the departmental budget
Manage allocation and security of tools of trade and equipment provided to staff
Manage external service providers
Prepare management reports
Manage risks within the department


Requirements:

Legal degree plus completed articles and pupillage
Postgraduate qualification
Experience in managing of professional misconduct complaints and disciplinary hearing processes
Minimum of 5 years relevant litigation work experience, post-articles
Corporate governance and compliance management experience
Understanding and appreciation of the built environment, government protocols and transformation initiatives
Understanding of relevant legislation within the Built Environment Regulatory framework (e.g. Architectural Profession Act 44, and Council for the Built Environment Act 43 of 2000;
Understanding of relevant policies and practice within the Regulatory framework
Strong communication skills (Verbal, Written and Presentation)
The role reports directly to the Registrar
