Role purpose:

Responsible for managing legal affairs in a manner which fully protects VSA's legal interests and manages all associated risks.

This includes negotiating and drafting legal agreements in support of Vodacom's commercial activities, and, in the event of litigation, ensuring that such is managed efficiently, effectively and in manner that protect value and the reputation of the company.


Your responsibilities will include:


Ensure VSA is provided with effective and efficient legal support covering all business touch points
Provide legal counsel and advice to business line leaders
Oversee the negotiation process and drafting of significant agreements and personally draft strategic legal agreements.


Dispute Resolution

Instruct and manage external attorneys (where necessary) and act on behalf of the company, where appropriate, competent, and legally permissible.

Oversee compliance with settlement terms and conditions, where amicable solutions to disputes have been found.


Provide guidance to, and manage the VSA legal team
Manage the VSA commercial legal team and function as a professional sounding board to colleagues.
Provide professional guidance where required on complex negotiations and agreements or matters requiring litigation.
Determine when matters warrant involvement by the Chief Officer and refer these as required by the DoA.


Mitigate risk and prepare legal risk reports
Assess risk levels in work being managed by the legal department and determine appropriate remedies.
Prepare legal risk, litigation, and compliance reports for the ARCC, EXCO and Risk Management Committees.
Keep Chief Officer fully informed of all developments in relation to resources and functional activities in the department


Support/Input in legal department strategy and structure
Provide support as required to the Chief Officer in defining legal department objectives, strategies, and structure.

BA (or other basic degrees) LLB and admitted as an Attorney
A minimum of 10 years practical legal experience, with a minimum of years in a corporate/commercial environment. Good knowledge of legislation applicable to the mobile telecommunications sector.
Ability to gain respect and provide professional (informal) leadership to professional colleagues.


Technical / Professional Expertise
Extensive commercial drafting experience
Litigation experience and legal process
Broad overarching legal experience extending to Public Law and Private Law.

The role requires an experienced lawyer with in-depth knowledge of legal contracting, legal writing, litigation, and associated risk management elements in a commercial environment.

A working knowledge of various disciplines of the law - more so administrative law, competition law, consumer protection law, constitutional law, commercial law, employment law, and privacy law - are essential requirements for the role.

Must be able to interact with and advise the business on matters which may have sizeable impact on core business functions and activities.
