The Motus Retail division has a Junior Legal Counsel opportunity for a suitably qualified and experienced legal professional.

  • To provide solutions to complex legal and business challenges to mitigate actual/ potential legal risks.
  • Partner with the business in litigation matters, the implementation of policies to comply with legal, regulatory requirements (such as POPIA) and contract management processes.
  • To ensure the provision of quality legal service that fulfils statutory, reporting, and legal advisory services to all business units within the division.

Position Overview:


_ Job content_

  • Manage complex litigation matters with specific reference to the Consumer Protection Act and other matters.
  • Guide and execute regulatory and litigation strategy in relation to regulatory bodies (MIOSA, NCC & NCT) and highprofile and precedentsetting matters.
  • Draft, review/update and renegotiate legal agreements, including Service Level Agreements and other legal documentation to adequately manage legal risks.
  • Promote legal, compliance and risk management best practices throughout the business.
  • Ensure legally compliant business practices and policies to protect the organisation from undue legal exposure.

Specific Role Responsibilities:


Specific Role Responsibilities

  • Review ongoing litigation cases and provide sound legal advice to management.
  • Develop strategic approaches to managing regulatory risks and resolving regulatory disputes.
  • Draft responses on factually and legally complex issues to industry bodies and regulators.
  • Manage the legal agreement database to ensure all information is up to date, signed and correctly linked to other relevant systems.
  • Attend to the drafting and reviewing of contracts and agreements and ensure they comply with relevant statutory and/or legal requirements.

_Stakeholder_

  • Appoint and instruct external legal counsel where required.
  • Supervise and direct outside counsel on multiple complex matters.
  • Cultivate and manage objective working relationships with a variety of stakeholders, including external legal counsel.
  • Liaise between external counsel and business to defend or prosecute a case to its logical conclusion.
  • Manage relationship with external counsel and ensure that their services are cost effective to the businesses they service.
  • Train business on new legislation and/or regulations.
  • Ensure effective relationships and SLA management with internal and external legal counsel.

  • Act in an ethical, transparent and morally defensible manner, including highlighting unethical practices.
  • Identify financial business risks to the company and escalate accordingly.
  • Identify opportunities to enhance efficiencies and reduce wasteful expenditure.

Qualifications and Experience:


Qualifications and Experience

  • Experience in legal drafting, advocacy and communication skills.
  • LLB Degree with 2+ years post qualification/admission experience in a law firm.
  • Sound legal and commercial knowledge and experience.
  • Commercial IP experience, including the divestment, acquisition and licensing of trademarks
  • Trademark litigation and opposition experience.
  • Demonstrative ability to work in a collaborative, fastpaced environment and make sound judgments under tight deadlines
  • Prior experience of litigating in civil courts and tribunals.
  • Experience in drafting commercial agreements including service level agreements and property relayed agreements.
  • Excellent problemsolving, written, and oral communication and interpersonal skills
