Core purpose of the role To manage regulatory risk and changes impacting Barloworld by developing and implementing appropriate measures to mitigate risk to the organisation.


Job Objectives

Strategic / Financial

  • Serve as a Project Lead on the review, maintenance, and establishment of key Group Regulatory Compliance
  • Programmes (competition, privacy, sanctions, etc.) benchmarked against global standards of compliance.
  • Implement and embed the Group Regulatory Compliance Framework to enable the identification, evaluation, managing and monitoring of regulatory compliance risks.
  • Coordinate the implementation of the Group's Protection of Personal Information policy and programme.
  • Serve as a gatekeeper for the review of proposed Group and divisional regulatory compliance policies and ensuring that policies are aligned with legislative / regulatory requirements.
  • Establish and maintain the Group Regulatory Universe across multiple jurisdictions and Barloworld sectors through the identification of applicable laws in key risk areas.
  • Compile and maintain Regulatory Compliance Risk Management Plans for identified regulatory risks.
  • Support the central function by assisting in developing policies, procedures, frameworks, and tools with specific focus on aligning policies with regulatory requirements and mitigating regulatory risks.
  • Facilitate the development, approval, and implementation of holistic Group Compliance Plans in order to address gaps identified.
  • Identify regulatory compliance matters that require followup or investigation, and, as appropriate, conduct investigations.
  • Monitor and track the status of Compliance Plans using a GRC system for purposes of assuring and auditing compliance to laws and regulations.
  • Maintain a Group Regulatory Risk Register
  • Assist with investigations relating to regulatory breaches.
  • Promote a regulatory compliance culture through effective compliance communications and training programmes around key developments in the regulatory landscape and the impact on business / operations.
  • Develop and implement relevant compliance training programmes.
  • Develop and execute an annual regulatory compliance plan based on the regulatory compliance strategy and the Barloworld strategy.
  • Ongoing reporting to key governance committees on the status of compliance to laws and based on established reporting dashboards and templates on key regulatory KPIs.
  • Project management in support of regulatory compliance requirements, implementation of systems, procedures, policies, and training requirements.
  • Liaising with Regulators.
  • Ensure that necessary training and awareness programmes for regulatory compliance matters are developed and rolled out into the Group.
  • Develop and manage strategic relationships with key stakeholders across the organisation.

Operational

  • Accurately analyse and legally interpret local laws and regulations per identified area of risk, for practical implementation into business process and systems.
  • Keep abreast of developments in local laws across jurisdictions on an ongoing basis and ensuring that any applicable developments in law are effectively communicated to relevant stakeholders and adequately addressed as part of a regulatory risk management framework.
  • Conduct regular regulatory compliance risk assessments in the business to identify relevant regulatory compliance risks and assisting business to formulate mitigation plans.
  • Test whether the business control is effective and adequate and ensure that business policies contain the right content addressing legislative requirements.
  • Facilitate and drive gap analyses with relevant stakeholders in order to determine the status of compliance to laws and regulations.
  • Manage relevant subscriptions and licenses relating to the ongoing maintenance of regulatory updates.
  • Ensure that reports are timeously submitted in alignment with agreed upon standards.

Stakeholders (internal & external customers, suppliers, shareholders, communities)

  • Liaise with local counsel, where necessary, to facilitate understanding of local laws.
  • Collaborate with and support the divisional regulatory compliance champions in implementing the Regulatory
  • Compliance Framework in the Barloworld Divisions.
  • Establish and maintain relationships with relevant stakeholders.
  • Liaise with local regulatory bodies / authorities as and when required.
