Job Advert Summary:

The purpose of the position is to oversee the Employee Relations function from a Group perspective, ensuring a harmonious workplace by implementing policies, procedures and ER interventions, to ensure compliance and to support the business objectives, whilst engaging/consulting with all stakeholders as and when required


Minimum Requirements:


  • LLB (Labour Law) or similar degree
  • Experience as a senior CCMA Commissioner (Advantageous)
  • A minimum of 10 years' experience in an ER/IR specialist role within a Blue-Collar/Industrial and/or Agricultural environment.
  • Exceptional oral and written communication skills in English
  • Proficient in Zulu, Tswana, Afrikaans.
  • Above average computer literacy in Word, PowerPoint & Excel
  • Valid Code 08 drivers' license and own reliable transport
  • Willing to travel extensively between regions (12 weeks per month)
  • Excellent understanding of South African Labour Law and associated legislation.
  • Must have dealt extensively with; policy development and implementation, disciplinary procedures, case management at CCMA and Labour Court level, wage negotiations, strike management, large scale retrenchments (S189) and large scale mergers and acquisitions (S197)
  • Excellent oral and written communication skills.
  • Thorough understanding of negotiation techniques.
  • Thorough understanding of dispute resolution.
  • Outstanding interpersonal skills
  • Ability to remain tactful, calm, and persuasive in controversial and/or confrontational situations.

Duties and Responsibilities:


Admin and reporting

  • Ensure that the ER policy framework is maintained and updated in accordance with the HR QMS.
  • Implement and maintain the ER module on the HRIS to ensure the availability of accurate and complete ER data for reporting purposes.
  • Monthly ER reporting to HR Director with complete statistics and data analytics.
  • Maintain an electronic library of all cases referred to the CCMA, with progress tracking.

Case Management and preparation

  • Where required and dependent on importance and risk of referred disputes/cases, represent the company at the various statutory dispute resolution bodies.
  • Assist operational HR Practitioners with case preparation.
  • Liaise and facilitate discussions with legal partners in respect of cases referred to the CCMA and/or Labour Court where legal assistance and opinions are required.
  • Assist operations with investigations and case preparation, dependent on importance and risk of pending internal disciplinary cases.

Collective Bargaining

  • Advise, guide and lead negotiations with Trade Unions and social partners, on wages/salaries, conditions of employment, policies & procedures, etc.
  • Ensure the correct implementation and administration of collective agreements.

Community Liaison

  • Establish a network with all major stakeholders within local communities.
  • Establish community consulting structures/forums in various regions.
  • Coordinate and drive community forum meetings in conjunction with operations HR Practitioners.

Compliance

  • Ensure legal compliance and consistent labour relation practice in the workplace.
  • Auditing of systems and policies against relevant labour legislation.
  • Facilitate the implementation of new/changes in labour legislation.
  • Proactively provide guidance and awareness (training) on new legislation to ensure compliance.
  • Provide oversight on all employee relations dispute cases within the company ensuring that sound, fair and appropriate practices are followed in accordance with legislation, agreements with employees/ union and company policies and procedures.
  • Coordinate and facilitate audits on labour brokers and subcontractors to ensure compliance to labour legislation.

Dispute Resolution

  • Assist with and facilitate dispute resolution to resolve issues as quickly as possible to minimize business risk.
  • Lead consultations to resolve complex and more difficult ER/IR issues e.g., policy negotiation, dispute handling, ER impact of larger organizational changes.

Management Support

  • Support operations to drive and manage sound Employee Relations.
  • Point of contact for Senior Management and HR Practitioners to provide advice and support on ER/IR issues.
  • Strike Management and support Operations Management during strikes.

Organisational Change

  • Lead and guide organisational and operational change processes (S189) and facilitate retrenchment consultations where required.
  • Advise the business on IR related aspects to new business growth, mergers, and acquisitions (S197) and commercial opportunities to understand and mitigate risk and manage smooth transition.
