About Thulani Dlamini:

Thulani Dlamini started working as a Legal Advisor at Johannesburg Community Legal                                                          Centre (Formerly known as Legal Aid) during 1999 to 2002, handling civil and labour matters. In 2022 he was offered a Mediation, Arbitration, and Labour Relations training by IMSSA through the Black Lawyers Association. During 1999 to 2000, he was also providing legal advice to MUSA (Musical Union of South Africa) and SAFPU (South African Football Association). In April 2002 he joined Legal Scorpion Protection as Legal Advisor and later in 2002 he was promoted as a Trainer Manager, providing training to the legal advisor on how to handle Labour matters at the CCMA and the Labour Court.

 

In 2003 he joined CCMA as a full time Commissioner and in 2005 he became a Part-time Commissioner of the CCMA until present. He has also served as a panellist in various Bargaining Councils i.e. Statutory Council, General Public Service Bargaining Council, Safety and Security Sectoral Bargaining Council (2005 to 2009) . Road Freight bargaining council, Metal & Engineering bargaining council (2010 until present), National Bargaining Council for the Chemical Industry (2008 to 2018), Tokiso (2018 until present) and Transnet Bargaining Council (2018 until present).   

 

  1. TASKS

 

• Provide support and advice on all labour-related matters to clients, relating to day-to-day workplace discipline, poor performance, incapacity processes, collective bargaining, unions, recognition of unions, Main and Collective Agreements, employment grievances as well as ad hoc labour relations

• Interpretation and application of relevant labour legislation

• Ensure labour compliance to South African laws and regulations

• Manage union negotiations e.g. wage and benefits

• Draft legal opinions, memoranda and briefing documents

• Draft documents, letters and contracts

• Draft disciplinary codes, codes of conduct and other policies

• Facilitate the hearing process for clients, supporting prosecution or playing the chairperson role

• Provide arbitration, litigation and mediation support

• Formulating formalities and drafting findings regarding settlements of disputes.

• Preparer  employers for conciliation, con/arb and arbitrations at the CCMA and various bargaining  councils 

• Keep current on trends and legislative changes, and provide advice thereof.

• Provide relevant training and coaching of client’s managers
